Terms of Service

These Terms of Service govern the use of Bexra school management software ("the Platform") provided by BexraTech ("we", "us", "Bexra Tech"), located in Patna, Bihar, India.

"You" refers to the school, institution, or organization that has subscribed to the Platform. The person accepting these terms on behalf of the school confirms they have the authority to do so.

By using the Platform, you agree to these terms. If you do not agree, you should not use the Platform.

Bexra Tech provides a cloud-based school management platform that may include, depending on your plan: a school website, an admin management panel, a teacher portal, a student and parent portal, fee management, attendance tracking, result management, WhatsApp communication tools, and automated data backups.

Features included in your subscription are determined by the plan you have selected. We reserve the right to add new features to plans and to adjust features with reasonable notice.

The Platform is provided "as is" for schools in India. We do not guarantee 100% uptime but aim to maintain availability above 99% on a monthly basis, excluding planned maintenance windows.

Platform plan pricing is ₹5 per student per month, based on the number of active students enrolled in your Bexra account. Presence plan pricing is a one-time payment of ₹5,000 unless otherwise agreed.

Payment is due monthly on the agreed billing date. We will notify you if a payment fails and allow 7 days to resolve the issue before access is suspended.

You may cancel your subscription at any time by notifying us via WhatsApp, phone, or email. Cancellations take effect at the end of the current billing period. No partial-month refunds are issued.

We reserve the right to update pricing with 30 days' written notice to your registered email. If you do not agree to the new pricing, you may cancel before the new rate takes effect.

You are responsible for ensuring that student data entered into the Platform has been collected with appropriate consent from parents or guardians, as required by applicable law including India's Digital Personal Data Protection Act.

You are responsible for maintaining the security of admin login credentials. Do not share admin passwords with unauthorised personnel.

You must not use the Platform to store, transmit, or process content that is illegal, fraudulent, defamatory, or violates the rights of third parties.

You must not attempt to reverse-engineer, copy, or resell the Platform, or allow third parties to access the Platform through your account.

All data you enter into the Platform - student records, fee history, attendance, results - belongs to your school. Bexra Tech acts as a data processor on your behalf, not as a data owner.

We will not share, sell, or use your school's data for any purpose beyond operating the Platform. See our Privacy Policy for full details.

You can request a full data export at any time. Exports are typically provided within 24 hours and guaranteed within 5 working days. Upon cancellation, your data is retained for 30 days before being permanently deleted.

We aim to keep the Platform available 24/7. Planned maintenance will be communicated in advance where possible. Emergency maintenance may occur without prior notice.

We are not liable for service interruptions caused by third-party infrastructure (hosting providers, internet connectivity, WhatsApp API availability), acts of nature, or events outside our reasonable control.

If a service outage lasting more than 24 consecutive hours occurs and is within our control, we will apply a proportional credit to your next invoice upon request.

Bexra Tech's total liability to your school for any claim arising from use of the Platform is limited to the amount you paid for the Platform in the 3 months preceding the claim.

We are not liable for indirect, consequential, or punitive damages - including loss of data beyond what is recoverable from backups, loss of revenue, or reputational harm.

Nothing in these terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Indian law.

You may terminate your subscription at any time. We may terminate your access if you breach these terms and fail to remedy the breach within 14 days of written notice.

We may immediately suspend access (without prior notice) if your account is being used illegally or poses a security risk to other users of the Platform.

Upon termination for any reason, your access to the Platform will cease at the end of the billing period. Data export requests must be made within 30 days of termination.

If Bexra Tech decides to discontinue the Platform, every active school will receive at least 90 days' written notice to the registered admin email before the shutdown date.

During the notice period you will receive a full export of your school's data in a standard readable format, and your account will retain at least 90 days of read-only access so you can migrate at your own pace.

These commitments survive any sale or transfer of the business: any successor operating the Platform is bound by them.

We may update these terms from time to time. We will notify you by email to your registered school admin email at least 14 days before material changes take effect.

Your continued use of the Platform after the effective date of the updated terms constitutes acceptance. If you do not accept the updated terms, you may cancel before they take effect.

These terms are governed by the laws of India. Any disputes arising from these terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.
