The Act was challenged and survived. In February 2024, in Association of Independent Schools Bihar v. State of Bihar, the Patna High Court upheld its constitutionality, holding that the law was aimed at ensuring education is not commercialised, and affirmed the committee's authority to review hikes above the ceiling. Schools planning fee policy on the assumption that the cap will be struck down are planning on a case that has already been decided.
The number the cap is measured against is per student, per year
The ceiling applies to the fee realised from the student, which is not the same as the fee printed on the fee card. Concessions, sibling waivers, part payments and arrears all move it. A school that can produce, per student, what was billed, what was waived and what was actually collected last year can compute its own permitted figure in an afternoon. A school working from register books usually cannot.
Parents have a documented route to complain
Under the Act a parent who believes the increase exceeded the permitted figure can take it to the Fee Regulatory Committee constituted for the division. That makes an ordinary parent query into something a school should be able to answer with a printed statement on the spot, which is a very different demand on the office than a shouting match at the counter.
